1. About these Terms
1.1 These Terms & Conditions (the “Terms”) govern access to and use of the ibGenius website and online platform available at [www.ibgenius.com] and any associated webpages or online learning environment (“Platform”, “ibGenius”), as well as the purchase and use of the educational products and services made available through the Platform.
1.2 The Platform is operated by HUMAN BREEZE L.P., a limited partnership established under Greek law, registered with the General Commercial Registry (G.E.MI.) under number 184779003000, with VAT number 802893840 and registered office at 25 Esperou Street, Kifisia, Greece (“we”, “us” or “our”).
1.3 Through the Platform, we may offer, among other things:
- e-learning courses;
- live online workshops;
- mock examination papers and packs;
- downloadable educational and revision resources;
- school and institutional packages;
- tutoring, career guidance and other educational support services; and
- any other educational products or services made available through the Platform from time to time.
1.4 These Terms apply to individual students, parents or guardians purchasing on behalf of students, teachers, tutors, schools, educational institutions and other organisations, as applicable.
1.5 Certain products or services may also be subject to additional terms, including our Digital Content Licence, Refund & Cancellation Policy or specific terms communicated at the time of purchase. Where additional terms apply, they form part of the agreement between you and us in relation to the relevant product or service.
1.6 Please read these Terms carefully before using the Platform or making a purchase. By creating an account, placing an order or otherwise expressly accepting these Terms where requested, you agree to be bound by them.
Nothing in these Terms affects any mandatory rights available to consumers under applicable law.
2. About ibGenius
2.1 IbGenius is an independent educational platform providing learning resources and educational support relating, among other things, to International Baccalaureate programmes and examinations.
2.2 International Baccalaureate®, IB® and any other relevant marks are registered trademarks of the International Baccalaureate Organization. IbGenius® is a registered trademark of ours identifying our independent educational platform and is not affiliated with, endorsed by, sponsored by or approved by the International Baccalaureate Organization.
2.3 References to International Baccalaureate programmes, subjects, examinations or terminology are made for descriptive and informational purposes in identifying the educational context to which the relevant ibGenius products or services relate.
3. Users under 18
3.1 The Platform is intended for teachers, schools, students, parents, tutors and other persons interested in the educational products and services offered by ibGenius.
3.2 Users under the age of 18 may use the Platform. Users who have reached the age of 14 may make purchases through the Platform using money earned through their own work or money provided to them for their free use or disposal. Purchases by younger users, or purchases by users under the age of 18 that do not fall within the above, must be made with the consent of their parent or legal guardian.
3.3 Where a parent, legal guardian, school or other organisation purchases access or educational resources for a student, that person or organisation is responsible for ensuring that the student's use of the Platform complies with these Terms and any applicable licence conditions.
3.4 Where personal data of children are processed through the Platform, such processing will be carried out in accordance with our Privacy Policy and applicable data protection law.
3.5 We may introduce reasonable age, parental authorisation or other verification measures where required by applicable law or by the nature of a particular service.
4. User Accounts
4.1 Certain products and services require the creation of a user account.
4.2 You must provide accurate, complete and up-to-date information when creating or using an account and must keep your account information updated.
4.3 Account credentials are personal to the registered user. Unless expressly permitted under a school or institutional arrangement, you must not:
- share your username or password with another person;
- permit another person to use your account;
- transfer or sell your account; or
- use another user's account.
4.4 You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account.
4.5 You must notify us without undue delay if you become aware of unauthorised access to or use of your account.
4.6 Where accounts are created, allocated or administered by a school or other organisation, additional institutional arrangements may apply regarding account administration, permitted users and access rights.
5. Orders and Contract Formation
5.1 The products and services available through the Platform, together with their main characteristics and applicable prices, will be described on the relevant product or service page.
5.2 Before placing an order, you are responsible for checking that you have selected the correct product, course, workshop, subject, level, examination paper, resource or licence type, as applicable.
5.3 By submitting an order, you make an offer to purchase the selected product or service subject to these Terms and any additional terms identified before purchase.
5.4 A contract is concluded when we accept your order and provide you with confirmation of the purchase by email or otherwise make the purchased product or service available to you, whichever occurs first.
5.5 If we are unable to accept an order, we will inform you and any amount already paid in respect of that order will be refunded.
6. Prices and Payment
6.1 Prices are displayed on the Platform in Euros. The total price payable, including VAT where applicable, will be clearly displayed before the order is placed.
6.2 Payment must be made using one of the payment methods made available through the Platform.
6.3 Payments are processed securely through our trusted third-party payment provider, Stripe Technology Europe, Limited. Your credit card details (type, name on the card, number, CVV, expiry date) are not processed by us nor stored on our own storage media during the transaction. We only have access to the identifiers provided by the authorized payment provider. Further information regarding the processing of personal data in connection with payments is provided in our Privacy Policy.
6.4 Access to a product or service may be withheld or suspended where payment has not been successfully completed, has been reversed or remains outstanding.
7. E-Learning Courses
7.1 E-learning courses may contain videos, text, quizzes, exercises, downloadable resources and other educational materials, as specified in the relevant course description.
7.2 Access to a course will be provided for the period stated on the relevant course page or at the time of purchase. Where no specific access period is stated, the applicable access arrangements will be communicated before purchase.
7.3 Access is granted to the user or users covered by the relevant purchase and may not be shared with other persons except where expressly permitted under an applicable school or institutional licence.
7.4 Course content may be updated from time to time in order to maintain its educational relevance, accuracy, technical functionality or alignment with changes to the relevant curriculum or examination framework. Any such changes will not materially reduce the principal functionality or educational purpose of a paid course during the applicable access period.
7.5 Completion of an ibGenius course does not guarantee any particular examination result, grade, admission outcome or other academic result. Educational outcomes depend on a range of factors, including the student's own preparation, participation and performance.
7.6 E-learning courses are educational support resources and are not a substitute for attendance at an authorised school, instruction from a student's teachers or the official materials and requirements issued by the relevant examination or educational body.
8. Live Online Workshops
8.1 Live workshops may be offered to students, teachers, schools or other users and may be delivered through Zoom or another video-conferencing service.
8.2 The date, start time, timezone, duration and any specific participation requirements will be communicated on the relevant booking page or in the booking confirmation.
8.3 Participants are responsible for ensuring that they have an adequate internet connection and compatible equipment and software necessary to participate.
8.4 We may establish reasonable rules for participation in order to ensure an appropriate and safe educational environment. Participants must not disrupt a workshop, misuse chat or communication functions, record or redistribute workshop content without permission, or engage in unlawful, abusive or inappropriate conduct.
8.5 If a workshop is recorded, participants will be informed in advance and any processing of personal data in connection with the recording will be governed by our Privacy Policy.
9. Digital Downloads, Mock Examination Packs and Other Resources
9.1 Digital resources may include mock examination papers, mark schemes, revision packs, teaching resources, PDFs and other downloadable or electronically accessible materials.
9.2 Before completing a purchase, you are responsible for checking the product description and ensuring that you have selected the correct product, including the correct subject, level, examination session and paper, as specified for the product.
9.3 Access to or use of digital resources is subject to the licence applicable to the product. Unless expressly stated otherwise, purchase of a digital resource does not transfer ownership of any intellectual property rights in that resource.
9.4 Certain digital resources may contain a watermark, purchaser identification, order information or other technical or identifying measures intended to protect the resource against unauthorised distribution.
9.5 You must not remove, alter, conceal or circumvent any copyright notice, watermark, access control or other rights-management information or technical protection applied to the resources.
9.6 Certain mock examination papers, mark schemes and other assessment materials may be made available exclusively to teachers and schools. Where a product is identified on the Platform as being restricted to teachers or schools, you must not purchase, access or make it available to persons who are not authorised to access it, unless you belong to the relevant user category.
10. School and Institutional Access
10.1 Schools and other educational organisations may purchase products or access arrangements intended for use by multiple teachers or students where such options are offered by ibGenius.
10.2 The number and category of permitted users, duration of access, permitted classroom use and any other licence limitations will be those specified in the relevant school package, quotation, order confirmation or other agreement with us.
10.3 A school or organisation purchasing access for multiple users is responsible for:
- ensuring that access is provided only to authorised users;
- taking reasonable steps to prevent unauthorised sharing of account credentials or resources;
- ensuring that its staff and, where appropriate, students are informed of the conditions applicable to their use of the Platform; and
- informing us where access allocated to a particular user needs to be withdrawn or reassigned, where reassignment is permitted.
10.4 Institutional access does not permit publication, resale, unrestricted distribution or sharing of ibGenius materials outside the purchasing organisation unless expressly agreed in writing.
11. Intellectual Property Rights
11.1 Unless otherwise expressly stated, the Platform and all materials made available through it, including courses, videos, presentations, questions, mock examinations, mark schemes, resource packs, teaching materials, graphics, text, trademarks, branding and other content, are owned by or licensed to us and are protected by the relevant provisions of Greek law, European law and international conventions. The Platform, as a whole, is also independently protected as original work of visual design and applied arts, as well as a collection of works, and constitutes intellectual property of ours.
11.2 Your purchase of a product or service grants only the limited rights of access and use applicable to that product. It does not transfer ownership of the underlying content or intellectual property rights.
11.3 The permitted and prohibited uses of digital educational content are set out in the Digital Content Licence, which forms part of the terms governing the purchase and use of such content.
11.4 Without prejudice to the Digital Content Licence, you must not reproduce, distribute, sell, sublicense, publicly make available, upload, publish or commercially exploit ibGenius content except as expressly permitted.
11.5 You must not use ibGenius content, whether in whole or in substantial part, to create competing educational products or services or datasets, or for the training, fine-tuning or development of artificial intelligence or machine-learning systems, except with our prior written permission.
12. Acceptable Use of the Platform
12.1 You must use the Platform lawfully and in accordance with these Terms.
12.2 You must not:
- interfere with the security or proper operation of the Platform;
- attempt to gain unauthorised access to another user's account or restricted areas of the Platform;
- introduce malware, malicious code or other harmful technology;
- scrape, systematically extract or harvest content or data from the Platform without authorisation;
- circumvent technical restrictions or access controls;
- use the Platform or its content in a manner that infringes our or any third party’s rights; or
- use the Platform for fraudulent, unlawful or abusive purposes.
13. Cancellation and Refund
13.1 For the purposes of these Terms, a “Consumer” is an individual who purchases products or services from ibGenius for purposes outside their trade, business or professional activity. A “Business Customer” is any person or entity purchasing products or services for purposes relating to their trade, business or professional activity, including schools, educational institutions, companies and other organisations. A teacher, tutor or other individual purchasing products or services for professional use will therefore be treated as a Business Customer in relation to that purchase.
13.2 Consumers have the rights and remedies provided by Greek consumer protection legislation, including Law 2251/1994 on Consumer Protection, as amended and in force. These include, subject to the conditions and exceptions provided by law, the statutory right to withdraw from certain contracts concluded online and the rights and remedies available where digital content or digital services are not supplied or do not conform to the contract.
13.3 Business Customers have the rights and remedies provided by the relevant provisions of the Greek Civil Code, including in cases of non-performance or improper performance of contractual obligations.
13.4 Both Consumers and Business Customers also benefit from the cancellation, refund, transfer and credit arrangements provided under our Refund & Cancellation Policy, which sets out in detail the arrangements applicable to each type of product or service offered through the Platform. The Refund & Cancellation Policy constitutes an integral part of these Terms.
14. Availability and Technical Requirements
14.1 We aim to keep the Platform and purchased digital services reasonably available. However, uninterrupted or error-free access cannot be guaranteed.
14.2 Access may occasionally be interrupted for maintenance, security, updates, technical problems or circumstances outside our reasonable control.
14.3 Where a technical problem attributable to us prevents access to purchased digital content or services, you should contact us so that we can investigate and restore access, correct the problem or provide another remedy, as appropriate.
14.4 You are responsible for maintaining the internet connection, browser, device, software and other technical requirements reasonably necessary to use the Platform. Any specific compatibility or technical requirements relating to a digital product or service will be communicated in the relevant product or service description before purchase.
15. Third-Party Services
15.1 Certain functions of the Platform may depend on third-party services, including payment providers, learning-management systems (LMS), video-conferencing services and other technical service providers.
15.2 Your use of third-party services may also be subject to the relevant provider's terms of service and privacy policy.
16. Suspension and Termination
16.1 We may suspend or restrict access to an account or purchased content, refuse service to any user or cancel purchases, where we reasonably believe that:
- these Terms or the applicable Digital Content Licence have been materially breached;
- an account or resource has been shared with unauthorised persons;
- the Platform is being used fraudulently or unlawfully;
- suspension is reasonably necessary to protect the security or integrity of the Platform or the rights of other users; or
- we are required to do so by law.
16.2 Before terminating paid access for a breach by the user, we may give the user reasonable notice and an opportunity to remedy the breach, taking into account the nature and seriousness of the breach. No prior notice will be required where the breach cannot reasonably be remedied or immediate suspension or termination is necessary to prevent fraud, unlawful use, security risks or infringement of third-party rights.
16.3 Suspension or termination of access for any of the reasons above does not entitle the user to a refund unless otherwise provided.
17. Educational Information and Disclaimer
17.1 We take reasonable care in preparing our educational content. However, curricula, examination formats, assessment criteria and official guidance may change.
17.2 Users remain responsible for checking any current official requirements applicable to their studies, teaching or examinations.
17.3 References to past or anticipated examination formats, topics, assessment methods or educational requirements do not constitute a representation or guarantee as to the content of any future examination.
17.4 Nothing on the Platform constitutes an assurance of a particular academic result.
18. Liability
18.1 We make reasonable efforts to ensure the availability and proper operation of the Platform and the products and services provided through it. However, we do not guarantee that the Platform, courses, digital content or other online services will be available at all times or operate without interruptions, delays, technical problems or errors.
18.2 We are not liable for any unauthorised interference by third parties affecting the Platform, user accounts, digital content, products, services or information made available through the Platform.
18.3 Educational content, courses, workshops, mock examinations, resource packs and other materials made available through the Platform are provided for educational and learning purposes. While we make reasonable efforts to ensure the quality and accuracy of our content, we do not guarantee any particular academic result, examination result, grade, admission outcome or other educational or professional outcome resulting from its use.
18.4 We are not liable for any loss or damage arising from the inability to access or use the Platform, a product or a service, or from any interruption, delay, error, defective performance or unavailability resulting from circumstances beyond our reasonable control, including failures or interruptions of internet, hosting, telecommunications, video-conferencing, payment or other third-party systems or services.
18.5 Third-party providers used in connection with the operation of the Platform or the provision of products or services operate independently from us. We are not liable for any loss or damage arising from their acts, omissions, failures, interruptions, errors or negligence.
18.6 We are not liable for any indirect or consequential loss or damage, or for any loss of profit, revenue, business, contracts, anticipated savings, commercial opportunity or data. In any event, our total aggregate liability arising out of or in connection with any purchased product or service cannot exceed the amount paid for the product or service giving rise to the claim.
18.7 The exclusions and limitations of liability set out in these Terms apply to the fullest extent permitted by law. Nothing in these Terms excludes or limits any liability, or affects any statutory right or remedy, that cannot lawfully be excluded or limited.
19. Personal Data Protection
19.1 Personal data collected through the Platform are processed in accordance with our Privacy Policy.
19.2 For information about the cookies and similar technologies used on the Platform and how you can manage your preferences, please see our Cookie Policy and cookie settings.
19.3 Both our Privacy Policy and our Cookie Policy are integral parts of these Terms.
20. Changes to these Terms and to the Services
20.1 We may amend these Terms from time to time to reflect changes in our products and services, the Platform, or legal and regulatory requirements.
20.2 Revised Terms will apply to purchases made after their publication. They may also apply to ongoing products or services purchased before their publication, provided that any such change does not affect rights that cannot lawfully be modified and, where necessary, reasonable notice of the change is given to the affected users.
21. Governing Law and Disputes
21.1 These Terms, any amendments thereto and any contract concluded under them are governed by Greek law.
21.2 Any dispute arising from or in connection with these Terms or your transactions with us, which cannot be resolved amicably, shall be submitted to the competent courts of Athens, Greece, except where mandatory rules on jurisdiction provide otherwise.
21.3 Before commencing formal proceedings, you are encouraged to contact us so that we can attempt to resolve the matter directly.
21.4 Users who qualify as consumers (i.e., natural persons acting outside their professional or business capacity) may, in case of a dispute with us, resort to Alternative Dispute Resolution (ADR). Consumers may contact any body listed in the official Registry of recognized and certified ADR entities maintained by the competent Greek authority. Our participation in any ADR procedure is not mandatory according to the current applicable law.
22. Final Provisions
22.1 If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions shall remain in effect.
22.2 A failure or delay by us to exercise any right under these Terms does not constitute a waiver of that right.
22.3 We may transfer our rights and obligations under these Terms in connection with a reorganisation, transfer of our business or similar transaction.
